​​Article 1: object

These general conditions are intended to define the rights and obligations of ROSE ET MOI and the Buyer of the products (hereinafter “the subscription(s)”). They apply exclusively between ROSE ET MOI, Sarl with a capital of €8,000 - 61 Rue du Puits Neuf 13100 Aix-en-Provence, Siret: 793 800 277 000 14 - APE code: 4776Z - Intra-community VAT number FR15793800277 (hereinafter “ROSE ET MOI”) and any natural person consumer (hereinafter “Individual”) or any professional (hereinafter “Professional”) making a purchase in store or online.

Any order placed with ROSE ET MOI therefore entails the Buyer's unreserved acceptance of these conditions. These general conditions may be modified at any time and without notice by ROSE ET MOI, the applicable conditions being those in force on the date of the order by the Purchaser. These general conditions of use and sale are permanently accessible on the Site at the following address:http://www.chez-laurent-naturellement.com.in a computer format allowing them to be printed and/or downloaded, so that the Buyer can reproduce or save them.

 

Article 2: Subscriptions

2.1. The subscription service is available in store or online on the Site.

2.2. The Buyer receives one or more bouquets depending on his Subscription. The Individual or Professional Buyer chooses:

-  the size of the bouquet ("Le Délicat", bouquet of seasonal flowers about 35 cm in diameter, "L'audacieux": about 45 cm in diameter, "L'Opulent" : about 55 cm in diameter), 

- the delivery frequency (1 bouquet per month, 2 bouquets per month or 4 bouquets per month) 

- the duration of his Subscription (3 months, 6 months or 12 months). 

At the end of the chosen period, the Subscription ends. 

The Buyer must contract a new Subscription if he wishes to continue. 

Subscriptions (size of the package, frequency of delivery, duration) cannot be modified during the contract. 

 

Article 3: Obligations of the Buyer

3.1. The Buyer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to make a purchase at the store or on the Site.

3.2. The Purchaser undertakes to communicate to ROSE ET MOI the actual and necessary information for the performance of the service covered by these conditions as requested and according to his situation, in particular his surname, first name, address, telephone. and valid email. The Buyer is responsible for the consequences resulting from false or inaccurate information transmitted or the recovery of which would be unlawful.

3.3. The Buyer may request the modification of his data either directly at the store at 55 bis Rue MIgnet, 13100 Aix-en-Provence or by e-mail atlaurentnaturellement@gmail.com. 

 

Article 4: Price, availability and delivery

4.1. The prices displayed in stores and on the Site are indicated in euros, all French taxes included (French VAT and other taxes that may be applicable) for Individuals and Professionals. For the subscription service, the delivery costs are included in the displayed price of the bouquets. Prices are subject to change at any time.

4.2. ROSE ET MOI reserves the right to cancel or refuse an order in the event of a dispute with the Buyer on a previous order.

4.3. To purchase one of the Subscriptions, the Buyer must go to the store at 55 bis rue Mignet, 13100 Aix-en-Provence or place an order by telephone at 09.83.96.09.53.or order via the Site.  

 

Article 5: Delivery

5.1. Terms

The Buyer chooses the terms of delivery of his flowers: date, day, time slot.

The Buyer chooses the said terms at the time of the order. The 1st delivery day chosen corresponds to the other delivery days of the subscription (e.g.: a Buyer buys a subscription with a delivery frequency of 4 times a month for 3 months. The 1st delivery day chosen is a Thursday. The following deliveries will also take place every Thursday of each week for the duration of the subscription.).  

The 1st day of delivery cannot be earlier than (D+5), D being the day of purchase of the product. However, if the Buyer wishes to modify these terms during the subscription, he must make the request by e-mail to laurentnaturellement@gmail.com. These changes must then be validated by ROSE ET MOI to be applied. Failing this, the terms initially chosen will remain applied. In any case, any modification implies a period of 48 hours to be implemented.

5.2. Delivery areas

ROSE ET MOI delivers its Products to Aix-en-Provence and its surroundings (Venelles, Puyricard, Coutheron, Eguilles, Celony, Les Milles, Luynes, Le Tholonet, Saint Marc de Jaumegarde, Meyreuil) by courier. For any other municipality, the Buyer must contact the shop at 09.83.96.09.53. for validation of the place of delivery.

5.3. Delivery method

Delivery is made by courier. The time slot is validated with the recipient before delivery. If the Buyer chooses delivery to a neighbour/caretaker or on the landing, ROSE ET MOI cannot be held responsible for damage, theft or other damage to the bouquet(s), the Buyer having the possibility of be delivered by hand at the date and time chosen by him.

The Buyer undertakes to provide all the necessary codes so that the delivery person can enter the premises of the building to ensure delivery in good and due form.

5.4. Case of impossibility of delivery

In the event that the Company is unable to meet the deadlines, the Customer is informed by any means such as e-mail or telephone. In the event of the Recipient's absence at the time of delivery, the carrier will contact the Recipient and leave a transit advice note in the mailbox, either a second delivery may take place or the Recipient must come and collect the order at the address mentioned on the notice of passage. In the second case, given the perishable nature of plant products, if the Recipient does not withdraw it within 48 hours, the sale will be deemed perfect, and the Seller cannot be held liable.

In the event of an error or omission in the wording of the delivery address preventing it from being carried out as well as in the event of refusal of the order by the Recipient, the Buyer releases the Seller from his responsibility for delivery and the sale is considered perfect.

 

Article 6: Payment 

6.1. The Buyer expressly declares to have all the necessary authorizations for the purposes of using the method of payment during the validation of his order. He also undertakes to ensure his solvency before any order, if ROSE ET MOI is unable to deliver the Subscription ordered. In the event of insolvency, ROSE ET MOI also reserves the right to suspend or cancel any order or delivery in the event of non-payment or cancellation of payment.

6.2. The Buyer agrees to pay the full price of the Prepaid Subscription in one go at the time of purchase.

6.3. Insofar as it is a purchase with a fixed term, the Buyer cannot terminate the prepaid Subscription, nor obtain a refund (even partial) of its price.

6.4. Payment can be made by:  

• Credit card: Payment for services can be made by credit card in store,   by telephone or on the Site: Carte Bleue, Visa, Mastercard. Cards issued by banks domiciled outside France must be international bank cards. The simple fact of providing the bank card number entails authorization to debit the Buyer's account up to the amount of the order.

• Bank transfer or bank check at the Boutique

 

​Item 7: Gift 

ROSE ET MOI proposes to offer the person of their choice a subscription. The Buyer pays for his "subscription" gift by telephone, on the site (with his credit card) or in store. 

The “Subscription Gift Card” is hand-delivered to the Buyer in store. If the purchase is made on the Site, the Buyer can choose to print the gift card at home or send an e-mail to the person receiving the gift voucher. 

The Buyer will make sure to provide the valid information of the person to whom he wishes to offer a gift: surname, first name, telephone number, delivery address. ROSE ET MOI undertakes to call the person receiving the gift to validate the day of delivery and the start of the subscription. 

 

Article 8: Right of withdrawal

In accordance with the provisions of Article L 221-28 of the Consumer Code, with regard to plants, roses or any other plant, as well as certain food products, being perishable products liable to deteriorate rapidly, the right retraction aroused cannot be exercised.

 

Article 9: Exchanges and Returns of Product(s)

For the same reasons as before, there are no exchanges or returns of Products, in the case of perishable goods.

 

Article 10: Force majeure, Liability and Claims

10.1. force majeure

ROSE ET MOI undertakes to provide every care for the implementation of the service. Nevertheless, its liability cannot be retained in the event of a breach of its contractual obligations due to a fortuitous event or a case of force majeure as defined by the case law rendered by the French courts. ROSE ET MOI implements all the means at its disposal to ensure the services covered by these general conditions of sale

10.2. Responsibility

The Seller's liability is excluded when the defect or damage is directly attributable to the Buyer and/or the Recipient, to the non-compliance by the Buyer and/or the Recipient with the maintenance and/or use instructions provided by the Seller (such as, for example, abnormal use, inappropriate use or poor maintenance), or when the damage results from a cause unrelated to the Product

10.3. Complaints

Despite all the care taken by the Seller to best satisfy its customers, the Buyer may, for any Product, file a complaint with the Seller. The Buyer may address his complaint to the Seller by email: laurentnaturellement@gmail.com 

The complaint (delivery error and/or non-conformity of the Product, in kind, in quantity or in quality compared to the description of the Product, etc.) must be formulated and, if the complaint concerns the quality or the conformity of the Product, it must be accompanied by a photograph justifying the state in which the Product arrived, at the time of delivery. The complaint must be made to  Vendeur no later than 48 hours after delivery of the Product. The complaint made by the Buyer must imperatively specify: the contact details of the Buyer (surname, first name, address, and possibly telephone number and email address, etc.), the reasons for the complaint, proof of payment for the Order.

Any complaint made beyond this period will therefore be rejected. The Seller undertakes to respond to the Buyer as soon as possible.

In the event that the Seller accedes to the Buyer's complaint, the latter may obtain:

-   replacement with an identical product depending on available stock,

-   or exchange for a product of equivalent quality and price, depending on available stock,

-   or, if replacement or exchange proves impossible, a credit note corresponding to the amount of the Order (delivery costs not included), excluding any other compensation or damages and interest.

 

Article 11: Protection of personal data

ROSE ET MOI undertakes to protect the Buyer's personal data. All personal data concerning him and that ROSE ET MOI has collected are treated with the strictest confidentiality. In accordance with the law of January 6, 1978 amended by the law of August 6, 2004, the Buyer has a right to access and rectify personal data concerning him. Any request must be made by e-mail addressed to laurentnaturellement@gmail.com

This data is only provided for the purpose of delivering the Products ordered through the Site. They are mandatory for the processing of his order and any checks carried out to fight against fraud.

The Buyer acknowledges that refusing to provide this personal data may make it impossible for ROSE ET MOI to process his order.

The Purchaser is also advised of the fact that within the framework of the operations of verification of the information provided during his order and for commercial purposes, the data may be transmitted to third parties for the purposes of verification or with the authorization of the Purchaser when the purpose is commercial.

The Purchaser has the possibility of opposing the possible transfer to a third party of personal data concerning him, except for the third parties responsible for verifying the mandatory data provided during the order, it being specified that this opposition may result in the impossibility to process his order.

Article 12: Use of Cookies

The Site's web page servers are likely to place cookies on the Visitor's computer, with the following purposes: personalization of the Site, traffic analysis, memorization of connection information, storage of products selected by the Visitor and added to his basket, carrying out advertising and statistical actions.  

During a first Visit to the Site, a banner indicating the presence of cookies is displayed.

Cookies are stored on the Visitor's terminal until they are withdrawn by the Visitor, within a limit of 13 months from their deposit on the Visitor's terminal.

However, the Visitor has the possibility of refusing the installation of these cookies or of deleting them once they have been installed by modifying the parameters of the Internet browser he is using.
